EOIR Mandates

Most of EOIR’s mandate falls under the INA, which can be found in Title 8 of the U.S. Code. When that public law was enacted, it consolidated many existing statutory provisions and reorganized the structure of immigration law. Congress has amended the INA many times since then.

EOIR must also follow numerous other laws, regulations, policies, authorities, and instructive materials and notices, including executive orders, BIA decisions, Administrative Appeals Office (AAO) decisions, and relevant federal court orders and settlement agreements.
