73. Dismissal And Appeal Of Complaints

The EEO Assistant Director may propose dismissal, in full or any part, of a complaint of discrimination. Only the Director, Equal Employment Opportunity Staff, Justice Management Division (JMD) may dismiss a complaint either partially or in full. The reason(s) for dismissal will be specified in a letter from the Director, EEO Staff, JMD to the complainant together with notification that the complainant has the right to appeal a decision involving a mixed case complaint to the MSPB or a Title VII complaint to the EEOC, or to file a civil action. The appropriate time limits for further action will be included in the notification.
