DECLARATION OF MICHAEL J. FORQUER
(28 U.S.C. § 1746)

I, Michael J. Forquer, under penalties of perjury, state:

  1. I am over the age of eighteen and fully competent to testify to the facts in this declaration. Except where otherwise noted, this declaration is based on my personal knowledge.
  2. I am a paralegal in the Antitrust Division of the United States Department of Justice and have held this position since March 1978.

  5. On March 31, 2003, I went to the Metro K IGA located at 1864 Columbia Road, Northwest; Washington, DC 20009. During this visit, I saw the following products on the shelves:
