1815. Defenses -- Double Jeopardy
The fact that a defendant has been administratively punished in prison for his/her attempted escape does not preclude, on double jeopardy grounds, a conviction for attempted escape, United States v. Boomer, 571 F.2d 543, 546 (10th Cir.), cert. denied, 436 U.S. 911 (1978). See also United States v. Stead, 528 F.2d 257 (8th Cir. 1975), cert. denied, 425 U.S. 953 (1976); and United States v.
