1775. Prison Offenses -- Elements -- 18 U.S.C. 1792 -- "Participation"

Section 1792 of Title 18 prohibits instigating, willfully attempting to cause, assisting or conspiring to cause a mutiny or riot. Participation in a federal prison riot constitutes assisting and willfully attempting to cause such a riot. See United States v. Farries, 459 F.2d 1057 (3d Cir. 1972), cert. denied, 410 U.S. 912 (1973). Thus, mere participation is prohibited and punishable as a crime. United States v. Bryant, 563 F.2d 1227 (5th Cir. 1977), cert. denied, 435 U.S. 972 (1978).
