ABSTRACT: The civil case files system was established and is maintained pursuant to 5 U.S.C. 301, 28 U.S.C. 547 and 44 U.S.C. 3101. This records system permits authorized USAO and EOUSA personnel to adequately compile, track, and pursue and resolve civil cases or matters. This system of records is a core element in the mission of the USAOs in representing the legal interests of the United States government.

PURPOSE: The civil case files system encompasses all records maintained for the purpose of litigating or otherwise resolving civil cases or matters handled by the 93 United States Attorneys Offices or the Executive Office for United States Attorneys.

ACCESS CONSTRAINTS: The information contained in the civil files of the USAOs and EOUSA is comprised of confidential and non-confidential records. The confidential records are maintained in folders in locked file drawers or safes. The non-confidential material is maintained in file folders in metal filing cabinets. Records maintained in electronic format are protected through the use of user identification numbers issued only to authorized personnel. All records maintained in the USAOs or EOUSA are maintained in offices which are locked after working hours in buildings which are secured by either Federal Protective Service, United States Postal Service or private building guards.

AGENCY PROGRAM: The USAOs are charged with the enforcement of United States law both civil and criminal in conjunction with the Department of Justice. EOUSA serves as a liaison between the 93 USAOs and the Department of Justice. Compilation and maintenance of civil case files serves as a necessary tool in the representation of the interests of the United States

SOURCES OF DATA: The information maintained in this system stems from underlying federal, state or local law enforcement investigation reports; administrative agency and client agency materials; attorney work product; witness information; depositions; court proceedings; and memoranda and reports from the courts.
