  • Exemption 1:  The court finds that "[defendant] states that N.S.A.'s determination that it could not acknowledge the existence or non-existence of intelligence information on Plaintiff is proper because a positive or negative response to Plaintiff's request would reveal information that is currently and properly classified in accordance with Executive Order 13526 and is thus exempt from disclosure under Section 552(b)(1) of FOIA."
