Saleh v. Mayorkas, No. 23-409, 2024 WL 3400261 (D.D.C. July 12, 2024) (Lamberth, J.)

Re:  Request for records concerning denial of plaintiff’s petition to classify foreign national spouse or child as immediate relative to allow beneficiary to immigrate to United States

Disposition:  Granting defendant’s motion to dismiss plaintiff’s FOIA claim

  • Litigation Considerations, Exhaustion of Administrative Remedies:  “[T]he Court will dismiss [plaintiff’s] FOIA claims.”  The court relates that “[plaintiff] has conceded that he failed to exhaust his administrative appeals.”  The court finds that “[h]e has therefore failed to plausibly allege his FOIA claims.”
