Pellegrino v. TSA, No. 15-3047, 2018 WL 3371699 (3d Cir. July 11, 2018) (Krause, J.)

Re:  Request seeking TSA records containing the requester's name

Disposition:  Affirming the district court's holdings on the plaintiff's FOIA claims

  • Procedural Requirements, Adequacy of Search:  The Court of Appeals for the Third Circuit "perceive[s] no error in the District Court's conclusion that the TSA conducted an adequate search[,]" explaining that "[t]he TSA's declaration attested to extensive searches, confirmed by the production of hundreds of responsive documents."  The Third Circuit also affirmed the district court's holding that the documents "fell within the FOIA's exemption."
