  • Procedural Considerations, Entities Subject to the FOIA:  The court adopts the Magistrate Judge's report and recommendation which recommended that plaintiff's claim arising from a request made to the Detroit Police Department, "'be sua sponte dismissed because the complaint fails to state a claim upon which relief can be granted.'"  The Magistrate Judge noted that, "''it is beyond question that [the federal] FOIA [statute] applies only to federal and not to state agencies.''"
