Disposition:  Granting government's motion for summary affirmance of district court's grant of government's motion for summary judgment

  • Litigation Considerations, Exhaustion of Administrative Remedies:  The Court of Appeals for the District of Columbia Circuit holds that "the district court properly held that [the requester] failed to exhaust his administrative remedies before filing suit."  The district court previously held that "SSA responded to [the requester's] FOIA request . . . more than 20 working days after its receipt of the . . . request."  However, "[the requester] filed his lawsuit [after government's response], yet in the interim, he did not file an administrative appeal of SSA's determination."
