Jarvis v. Comm'r Soc. Sec. Admin., No. 18-5170, 2018 WL 6722401 (D.C. Cir. Dec. 18, 2018) (per curiam)
Re: Request for statistical records regarding awards and denials of disability benefits
Disposition: Granting government's motion for summary affirmance of district court's grant of government's motion for summary judgment
- Litigation Considerations, Exhaustion of Administrative Remedies: The Court of Appeals for the District of Columbia Circuit holds that "the district court properly held that [the requester] failed to exhaust his administrative remedies before filing suit." The district court previously held that "SSA responded to [the requester's] FOIA request . . . more than 20 working days after its receipt of the . . . request." However, "[the requester] filed his lawsuit [after government's response], yet in the interim, he did not file an administrative appeal of SSA's determination."
