Disposition:  Granting defendant's motion for summary judgment

Litigation Considerations, Exhaustion of Administrative Remedies:  The court holds that "[t]he IRS need not spring into action simply because Plaintiff placed a request in the mail, particularly when Plaintiff appears to have sent his FOIA request to an incorrect address."  "On summary judgment Plaintiff must produce some evidence to show that the IRS actually received a proper FOIA request."  The court finds that plaintiff "do[es] not establish that he submitted a proper FOIA request to the IRS."
