B. Policy.

  1. This chapter establishes the Department's pay-setting policy when a GS employee who is on a LEO special salary rate and/or a special salary rate approved by OPM under 5 U.S.C. 5305 receives a promotion to a GS position subject to a LEO special salary rate and/or a special salary rate approved by OPM under 5 U.S.C. 5305.

    Note: Promotion of a non-special salary rate GS employee to a GS special salary rate position is covered by 5 CFR 530.306(f).
     
  2. When promoting a GS employee to a position subject to a LEO special salary rate and/or a special salary rate approved by OPM under 5 U.S.C. 5305, components will set pay by following these steps:
     
    1. Identify the employee's current highest applicable scheduled rate of basic pay;
       
    2. Using the schedule for the rate identified in step a., compute the dollar amount of two step increases at the employee's current grade;
       
    3. Add the result of step a. to the result of step b.;
       
    4. On the applicable schedule for the target grade , identify the lowest step in the target grade that exceeds the dollar amount computed in step c.;

      Note: If the LEO special salary rate and the special salary rate under 5 U.S.C. 5305 are identical, use the LEO special salary rate.
       
    5. The employee is entitled to the highest applicable scheduled rate of BASIC pay, i.e., the regular GS, the LEO special salary rate, or a special salary rate approved by OPM under 5 U.S.C. 5305, for the grade and step identified in step d.; and
       
    6. For the grade and step identified in step d., the employee is also entitled to the greater TOTAL pay of:
       
      1. the LEO special salary rate, plus any applicable locality pay or special pay adjustment for LEOs; or
         
      2. the special salary rate under 5 U.S.C. 5305.

      Note: Locality pay and special pay adjustments for LEOs are paid on top of LEO special salary rates, but not on top of special salary rates under 5 U.S.C. 5305.
