Update – January 8, 2019: On January 7, 2019, Michael Baker’s conviction and judgment were affirmed by the U.S. Court of Appeals for the Fifth Circuit.


Michael Baker has appealed his conviction and judgement in the Fifth Circuit and the court will hold an oral argument on December 3, 2018, at 1:00 PM, in the U.S. Court of Appeals for the Fifth Circuit, East Courtroom, 600 Camp Street, New Orleans, LA 70131.


On January 5, 2018, Michael Gluk was sentenced to 50 months in prison, followed by 3 years of supervised release, and was ordered to pay a $50,000 fine  and forfeit $677,804. For more information, please see the issued press release.


On November 3, 2017 Michael Baker was sentenced to 240 months in prison, followed by 5 years of supervised release, and was ordered to pay a $1 million fine and forfeit $13.7 million.  For more information, please see the issued press release.

Defendant Michael Gluk is scheduled to be sentenced on January 5, 2018 at 9:00 AM.

Defendant Baker is scheduled to be sentenced on November 3, 2017, at 2:00 PM.


On August 18, 2017, Michael Baker, the former CEO of ArthroCare, was convicted by a jury on one count of conspiracy to commit wire and securities fraud, seven counts of wire fraud, two counts of securities fraud, and two counts of false statements charged in an April 2014 superseding indictment. Baker was acquitted on two counts of wire fraud and one count of false statements. For more information, please see the issued press release.


On June 14, 2017, Michael Gluk pleaded guilty to one count of conspiracy to commit securities and wire fraud. As a result, Michael Gluk will not have a trial on August 7, 2017. No sentencing date has been set.

Michael Baker is pending retrial set for August 7, 2017, at 8:30 AM.


On March 27, 2017, the court scheduled a status conference for May 11, 2017, at 10:00 AM. The purpose of the status conference is to address matters pending before the court.


On February 7, 2017, the court scheduled Michael Baker and Michel Gluk’s retrial for August 7, 2017, at 8:30 AM.


Michael Gluk and Michael Baker appealed their convictions and sentences, and on August 4, 2016, the Court of Appeals for the Fifth Circuit vacated their sentences and remanded for a new trial.


On August 29, 2014, Michael Baker and Michael Gluk were sentenced for their roles in a $750 million securities fraud scheme. Baker was sentenced to 240 months in prison (concurrent as to counts), followed by 5 years of supervised release, and was ordered to pay a $1 million fine. Gluk was sentenced to 120 months in prison (concurrent as to counts), followed by 5 years of supervised release, and was ordered to pay a $50,000 fine.

Baker and Gluk were convicted by a jury in June 2014 on one count of conspiracy to commit wire and securities fraud, nine counts of wire fraud, and two counts of securities fraud charged in an April 2014 superseding indictment; Baker was also convicted on three counts of false statements.


On August 1, 2013, Michael Baker, the former chief executive officer of ArthroCare Corporation was arraigned before Magistrate Judge Mark Lane.


On July 25, 2013, Michael Gluk, the former chief financial officer of ArthroCare Corporation was arraigned before Magistrate Judge Mark Lane.


On July 13, 2013, an indictment was unsealed charging Michael Baker, the former chief executive officer of ArthroCare Corporation (ArthroCare), and Michael Gluk, ArthroCare’s former chief financial officer, with one count of conspiracy to commit wire and securities fraud, 11 counts of wire fraud and two counts of securities fraud. The indictment also charges Baker with three counts of false statements.
