Court Assigned: This case is assigned to Judge John M. Gerrard, U.S. District Court for the District of Nebraska, Robert V. Denney Federal Building, 100 Centennial Mall North, Lincoln, NE 68508. Unless noted in an update below, all court events will take place at this location.


UPDATE – April 16, 2018: On March 12, 2018, defendant Gilbert Lundstrom requested that the court lower his monthly restitution obligation due to his changed economic circumstances. If you have any questions or concerns please contact our office by phone or email as soon as possible.


On January 19, 2018, the Court of Appeals for the Eight Circuit affirmed Gilbert Lundstrom’s conviction and judgment.


On June 6, 2017, the Court of Appeals for the Eight Circuit heard oral argument on Gilbert G. Lundstrom’s appeal; a decision is pending. To listen to the argument, please click here.


Defendant Gilbert G. Lundstrom has filed an appeal in the Court of Appeals for the Eighth Circuit; that case (court docket number 16-2313) is pending before the Court of Appeals.


On March 23, 2016, Gilbert G. Lundstrom, former CEO of TierOne Bank, was sentenced to 132 months in prison, followed by 2 years of supervised release, and was ordered to pay a $1,200,000 fine, and pay, jointly and severally with his co-defendants, $3,122,696 in restitution. It is important for you to know that just because the Court ordered the defendant to make restitution in this case, it does not mean that the defendant is financially capable of making restitution at this time. In the event that sufficient restitution payments are received from the defendant, the funds will be distributed by the Clerk of the United States District Court for the District of Nebraska.


On November 6, 2015, a jury in the District of Nebraska found former CEO of TierOne Bank, Gilbert G. Lundstrom, guilty on 12 of 13 counts, including charges of conspiracy to commit wire fraud and securities fraud, conspiracy to falsify bank entries, wire fraud, securities fraud, and falsifying bank entries.
