Order

THIS MATTER is before the Court upon the Motion For Entry Of Default Final Judgment (DE 6) filed herein by the Plaintiff, United States of America. The Court has carefully considered the merits of said Motion, has reviewed the entire court file herein and is otherwise fully advised in the premises.

The Court notes that on February 13, 1996, the Defendant, Scuba Retailers Association, Inc., was duly served (Exhibit 2 annexed to DE 6) with a copy of the Summons and Complaint filed herein, and that said Defendant has failed to file the appropriate Motion or responsive pleading within the time prescribed by law. The Court further notes that on May 1, 1996, the Clerk of the United States District Court for the Southern District of Florida entered a Default against said Defendant for its failure to appear, answer or otherwise plead in this action.

Accordingly, after due consideration, it is

ORDERED AND ADJUDGED that the Plaintiff's Motion For Entry Of Default Final Judgment (DE 6) be and the same is hereby GRANTED. Default Final Judgment shall be entered by separate order of the Court.
