Dear Mr. Zwick:

Thank you for the opportunity to submit comments on the Notice of Inquiry and Advanced Notice of Rulemaking for the September 11 th Victim Compensation Fund of 2001 ("the Act"). I offer comments and recommendations in the following three areas.

1. It was not the intent of Congress or the President to preclude those who proceed with claims under the Act from also filing suits against the assets of Osama Bin Ladin, El Queda, the Taliban or any other terrorist individual, organization, or government involved with the events of September 11 th. Such "frozen asset" suits should be specifically excluded from the waiver provisions under the rules implementing the Act.

2. The economic loss amount should not be reduced or offset by amounts received from life insurance proceeds or other benefits or assets owned by the September 11 th victims.

3. The rules should be very clear as to the rights of those who dismiss civil actions within the ninety day period in an effort to file a claim under the Act, but then are subsequently deemed ineligible under the Act or elect not to file a claim. Those individuals should be returned to the "status quo" so that they may, if they so choose, file in another forum.
