Indictments Returned by Federal Grand Jury

ELKINS, WEST VIRGINIA - Indictments charging drug and gun offenses were returned by a federal grand jury sitting in Elkins, West Virginia, on June 18, 2012.

United States Attorney William J. Ihlenfeld, II, announced that:

BREANNE MCULTY, age 22, of Petersburg, West Virginia, was named in a 5-count Indictment. Count One charges MCULTY with Conspiracy to Manufacture Methamphetamine and Possess Pseudoephedrine with the Intent to Manufacture Methamphetamine from May 17, 2011, to December 2, 2011. Counts Two, Three and Four charge MCULTY with Possession of Pseudoephedrine Knowing it Would be Used to Manufacture Methamphetamine on October 5, November 15 and November 18, 2011, in Keyser, West Virginia. Count Five charges MCULTY with Threats to a Material Witness on April 9, 2012, in an effort to prevent the witness from testifying in an official proceeding. If convicted, MCULTY faces a maximum penalty of 20 years imprisonment and a fine of $1,000,000 as to Count One and 20 years imprisonment and a fine of $250,000 as to Counts Two, Three, Four and Five.

The case will be prosecuted by Assistant United States Attorney Stephen D. Warner and was investigated by the United States Forest Service, Immigration and Customs Enforcement, the Grant County Sheriff’s Department and the West Virginia State Police.

CHRISTOPHER WILLIAMS, age 38, of Mill Creek, West Virginia, was named in a 3-count Indictment. Count One charges WILLIAMS with Possession of a Firearm on December 11, 2011, by a Person under Domestic Violence Restraining Order by the Family Court of Randolph County. Count Two charges WILLIAMS with Possession of a Firearm on December 11, 2011, after having been convicted in the Circuit Court of Cabell County of the felony offense of burglary. Count Three charges WILLIAMS with the Possession of a Stolen Firearm on December 11, 2011. The Indictment also contains a Forfeiture Allegation wherein the United States seeks to forfeit three firearms. If convicted, WILLIAMS faces a maximum exposure of 10 years imprisonment and a fine of $250,000 on each count. This case will be prosecuted by Assistant United States Attorney Stephen D. Warner and was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives.

It should be noted that the charges contained in the Indictment are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
