Fairmont Resident Indicted by Federal Grand Jury
Appears in Federal Court

CLARKSBURG, WEST VIRGINIA — A 23 year old Fairmont, West Virginia, resident named in a six-count Indictment returned by a Federal Grand Jury sitting in Martinsburg, West Virginia, on January 18, 2012, appeared before Magistrate Judge John S. Kaull on January 27, 2012.

United States Attorney William J. Ihlenfeld, II, announced that: JERMAINE CLAY was charged in Counts One, Two, Three, Four and Six with the distribution of crack cocaine within 1,000 feet of the 5th Street Gym and in Count Five with the distribution of cocaine hydrochloride within 1,000 feet of the 5th Street Gym in Marion County, West Virginia. CLAY, who is free on bond, faces a maximum exposure of 1 to 40 years imprisonment and a fine of $2,000,000 on each count.

This case will be prosecuted by Assistant United States Attorney Zelda E. Wesley and was investigated by the Three Rivers Drug Task Force, consisting of officers from the Fairmont and Monongah Police Departments.

It should be noted that the charges contained in the above-referenced Indictments are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
