Glen Dale Resident Indicted, Arrested on Drug Charges
WHEELING, WEST VIRGINIA - A 26-year old Glen Dale, West Virginia, resident was arrested today by officers of the Marshall County Sheriff’s Department, the Glen Dale Police Department and agents of the Drug Enforcement Administration and the United States Marshals Service, pursuant to an indictment returned by a federal grand jury this week in Wheeling.
According to United States Attorney William J. Ihlenfeld, II, JOSEPH A. MCDONALD was indicted earlier this week on two counts of “Distribution of Oxycodone within 1,000 Feet of a Protected Location,” two counts of “Distribution of Cocaine Base within 1,000 Feet of a Protected Location,” one count of “Distribution of Cocaine within 1,000 Feet of a Protected Location,” one count of “Distribution of Oxycodone,” and, two counts of “Distribution of Oxycodone and Cocaine within 1,000 Feet of a Protected Location.”
At the time of the arrest today a federal search warrant was executed on
MCDONALD’s residence in Marshall County and evidence of drug activity was found.
MCDONALD appeared in court today for an initial appearance and was remanded pending a detention hearing which has been scheduled for December 11, 2012.
If convicted, MCDONALD faces up to 40 years imprisonment and a $2,000,000 fine on the seven counts of distribution near a school and up to 20 years imprisonment and a
$1,000,000 fine on the final distribution count.
The case will be prosecuted by Assistant United States Attorney John C. Parr.
The charge contained in the indictment is merely an accusation and is not evidence of guilt. The defendant is presumed innocent until and unless proven guilty.
