Federal Grand Jury Returns Indictments

ELKINS, WEST VIRGINIA — Six individuals were named in five Indictments returned by a federal grand jury sitting in Elkins, West Virginia, on December 18, 2012.
United States Attorney William J. Ihlenfeld, II, announced the following indictments: PATRICK S. CRITES, age 46, of Moorefield, West Virginia, was named in a one-count
indictment charging him with “Transmitting Threatening Communications in Interstate
Commerce” on November 28, 2012. If convicted, CRITES faces up to five years imprisonment and a $250,000 fine. This case will be prosecuted by Criminal Chief Shawn A. Morgan and was investigated by the United States Secret Service, as the threat was allegedly made to the White House.

JUAN MARRON-CERDA, age 33, was charged in a one-count indictment with “Re- Entry by a Removed Alien.” On May 7, 2012, MARRON-CERDA was found in the Berkeley County, West Virginia, after having been removed in March of 2008, and had not received consent to reapply for admission to the United States. If convicted, MARRON-CERDA faces up to two years imprisonment, a $250,000 fine and deportation. This case will be prosecuted by Assistant United States Attorney Paul T. Camilletti and was investigated by US Immigration and Customs Enforcement, Homeland Security Investigations (ICE/HSI).

KELLEY LEIGH COHENOUR, age 35, and WILLIAM JOSEPH RUSSELL, age 38, of Cass, West Virginia, were named in a seven-count indictment. Count One charges COHENOUR and RUSSELL with “Conspiracy to Distribute Methamphetamine” from October 1, 2011, to April 13, 2012, in Pocahontas County, West Virginia. Count Two charges COHENOUR and RUSSELL with”Maintaining a Drug-Involved Premise” from October 1,
2011, to April 13, 2012, to manufacture, store and use methamphetamine. Counts Three and
Four charge COHENOUR and RUSSELL with “Possession of Material Used in the

Manufacture of Methamphetamine” on October 13, 2011, and April 13, 2012. Counts Five and Six charge COHENOUR with “Possession of Pseudoephedrine to be Used in the Manfacture of Methamphetamine” on October 3 and 11, 2011. Count Seven charges RUSSELL with “Possession of Pseudoephedrine to be Used in the Manfacture of Methamphetamine”on October 5, 2011. If convicted, COHENOUR and RUSSELL face up to 20 years imprisonment and $1,000,000 fine as to Count One; 20 years imprisonment and a $500,000 fine as to Count Two; 10 years imprisonment and a fine of $250,000 as to each of Counts Three and Four; and
20 years imprisonment and a $250,000 as to each of Counts Five, Six and Seven. This case will be prosecuted by Assistant United States Attorney Stephen D. Warner and investigated by the West Virginia State Police.

RODOLFO VILLAGOMEZ CORREA a/k/a “CHINO,” age 32, of Buckhannon, West Virginia, was named in a six-count indictment. Counts One and Three charge CORREA with “False Statement to Acquire a Firearm” on January 19, 2011, and June 26, 2011, in Lewis County. Count Two charges CORREA with “Receipt of a Firearm by an Alien Illegally in the United States” on February 21, 2011, in Upshur County. Count Four charges CORREA with “Possession of Fraudulent Identity Document by Alien Illegally in the United States” on February 6, 2012, in Upshur County. Count Five charges CORREA with “Possession of Firearms by an Alien Illegally in the United States” on July 24, 2012, in Upshur County. Count Six charges CORREA with “Possession of Fraudulent Permanent Resident Card” on July 24, 2012, in Upshur County. The indictment also contains a forfeiture allegation wherein the United States seeks to forfeit sixteen firearms which were seized from CORREA.

If convicted, CORREA faces up to 10 years imprisonment and a $250,000 fine on each of the six counts. This case will be prosecuted by Assistant United States Attorney Stephen D. Warner and was investigated by U.S. Immigration and Customs Enforcement, Homeland Security Investigations (ICE/HSI).

TROY ANTJUAN CLAYTON a/k/a “NY” a/k/a “PASTOR,” age 29, of Clarksburg, West Virginia, was named in a ten-count indictment related to the alleged trafficking of crack cocaine. CLAYTON is charged with one count of “Conspiracy to Distribute More than 28
Grams of Crack Cocaine”, seven counts of “Distribution of Crack Cocaine within 1,000 Feet of a Protected Location,” one count of “Maintaining a Drug-Involved Premise” to store, distribute and use crack cocaine, and one count of “Distribution of Crack Cocaine.” The case will be prosecuted by Criminal Chief Shawn A. Morgan and was investigated by the Harrison Drug and Violent Crime Task Force.

All of the charges contained in the above-referenced indictments are merely accusations and not evidence of guilt, and each defendant is presumed innocent until and unless proven guilty.
