Grand Jury Indicts Four Individuals

MARTINSBURG, WEST VIRGINIA - Four individuals were named in three Indictments returned on September 20, 2011, by a Federal Grand Jury sitting in Martinsburg, West Virginia.

United States Attorney William J. Ihlenfeld, II, announced that:

❶LARNELL TORRENCE MINOR, age 35, of Harpers Ferry, West Virginia, was named in a one-count Indictment. MINOR is charged with failure to register as a sex offender between August of 2010 and August of 2011, in the Northern District of West Virginia. If convicted, MINOR faces a maximum penalty of 10 years imprisonment and a fine of $250,000. The case will be prosecuted by Assistant United States Attorney Erin K. Reisenweber and was investigated by the United States Marshals Service.

❷MICHAEL ANTHONY CAPE, age 25, of Martinsburg, West Virginia, was named in a one-count Indictment. CAPE is charged with the bank robbery of BB&T Bank in Berkeley County, West Virginia, on July 21, 2011. If convicted, CAPE faces a maximum penalty of 20 years imprisonment and a fine of $250,000. The case will be prosecuted by Assistant United States Attorney Paul T. Camilletti and was investigated by the Berkeley County Sheriff’s Department and the Federal Bureau of Investigation.

❸D’ANGELO ANTOINE ALTON, age 25, and ANNE MARIE ALSTON, age 30, of Martinsburg, were named in a six-count Indictment. Counts One and Five charges D’ANGELO with possession of a firearm on March 25, 2011, and May 4, 2011, in Berkeley County, after having previously been convicted of a crime punishable by imprisonment for a term exceeding one year. Counts Two and Four charge D’ANGELO with the distribution of crack cocaine on April 4, 2011, and May 4, 2011, in Berkeley County. Count Three charges D’ANGELO and ANNE MARIE with the distribution of crack cocaine on April 21, 2011, in Berkeley County. Count Six charges D’ANGELO with the possession with intent to distribute crack cocaine on May 10, 2011, in Berkeley County. Count Seven charges D’ANGELO with possession of ammunition on May 10, 2011, in Berkeley County, after having previously been convicted of a crime punishable by imprisonment for a term exceeding one year. If convicted, D’ANGELO faces a maximum exposure of 10 years imprisonment and a fine of $250,000 as to Counts One, Five and Seven; 20 years imprisonment and a fine of $1,000,000 as to Counts Two, Three and Four; and, 5 to 40 years imprisonment and a fine of $2,000,000 as to Count Six. If convicted, ANNE MARIE faces a maximum exposure of 20 years imprisonment and a fine of $1,000,000.

The case will be prosecuted by Assistant United States Attorney Paul T. Camilletti and was investigated by the Martinsburg Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives.

It should be noted that the charges contained in the Indictment are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
