Two Clarksburg Residents Arrested on Drug Charges

CLARKSBURG, WEST VIRGINIA - Two Clarksburg residents were arrested on August 16, 2011, pursuant to a ten-count Indictment returned on August 9, 2011, by a Federal Grand Jury sitting in Elkins, West Virginia.

United States Attorney William J. Ihlenfeld, II, announced that:

TRENTON D. BOURGEOIS, age 29, and RICHARD HUGHES, age 37, were charged in Count One of the Indictment with conspiracy to distribute hydromorphone and hydrocodone from the Fall of 2010 to January of 2011 in Harrison County, West Virginia. Counts Two, Four, Seven, Eight and Ten charge BOURGEOIS and HUGHES with the distribution of hydromorphone within 1,000 feet of the Glen Elk City Park, also known as North Side Park, playground, on September 14, 2010; October 15, 2010; November 22, 2010; December 13, 2010; and, January 14, 2011. Counts Three and Five charge HUGHES with the distribution of hydrocodone within 1,000 feet of the North View Elementary School on October 3, 2010 and October 30, 2010. Count Six charges BOURGEOIS and HUGHES with the distribution of hydromorphone on November 1, 2010. Count Nine charges HUGHES with the distribution of hydromorphone within 1,000 feet of the Glen Elk City Park, also known as North Side Park, playground on December 21, 2010. The Indictment also contains a Forfeiture Allegation wherein the United States seeks to forfeit a 2003 Chrysler 300M belonging to BOURGEOIS and seeks a money judgment of at least $2,250.

If convicted, BOURGEOIS and HUGHES face a maximum exposure of 20 years imprisonment and a fine of $1,000,000 as to Counts One and Six; a maximum exposure of 1 to 40 years imprisonment and a fine of $2,000,000 as to Counts Two, Four, Seven, Eight, Nine and Ten; and, a maximum exposure of 1 to 20 years imprisonment and a fine of $1,000,000 as to Counts Three and Five.

BOURGEOIS and HUGHES appeared before Magistrate Judge John S. Kaull on August 16, and were released on bond. Their next Court appearance is scheduled for August 19, 2011, at 3:30 p.m. before Magistrate Kaull.

This case will be prosecuted by Assistant United States Attorney Robert H. McWilliams, Jr., and was investigated by the Harrison County Drug & Violent Crime Task Force, consisting of officers from the Clarksburg Police Department and the Bridgeport Police Department.

It should be noted that the charges contained in the Indictment are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
