Junior Resident Arrested on Methamphetamine Charges

ELKINS, WEST VIRGINIA — A 36 year old Junior, West Virginia, resident was arrested this week on charges contained in an Indictment returned by a Federal Grand Jury sitting in Elkins, West Virginia, on April 19, 2011.

United States Attorney William J. Ihlenfeld, II, announced that FOSTER GAY WILLIAMS was arrested after being named in an 18-count Indictment. Specifically, WILLIAMS was named in one count of the Indictment charging him with conspiring to manufacture methamphetamine from December 2010 to April 2011 in Randolph County; 11 counts of possession of pseudoephedrine with the intent to manufacture methamphetamine; five counts of possession of material used to manufacture methamphetamine; and one count of maintaining a drug-involved premise in Elkins.

WILLIAMS had an initial appearance before Magistrate Judge John S. Kaull and is currently in custody pending a detention hearing to be held on Friday.

If convicted, WILLIAMS faces a maximum penalty of 20 years imprisonment and a fine of $1,000,000 on the conspiracy count; a maximum penalty of 20 years imprisonment and a fine of $250,000 on each of the 11 counts of possession of pseudoephedrine; a maximum penalty of 10 years imprisonment and a fine of $250,000 on each of the five counts of possession of materials used to manufacture methamphetamine; and a maximum penalty of 20 years imprisonment and a fine of $250,000 for maintaining a drug-involved premise.

The case will be prosecuted by Assistant United States Attorney Stephen D. Warner. The case was investigated by the West Virginia State Police and the Junior Police Department.

It should be noted that the charges contained in the Indictment are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
