Grand Jury Indicts Three Individuals

WHEELING, WEST VIRGINIA - Three individuals were named in two Indictments returned on April 6, 2011, by a Federal Grand Jury sitting in Wheeling, West Virginia.

United States Attorney William J. Ihlenfeld, II, announced that:

CALVIN J. HEWEY, age 33, and JODI BURGHARDT, age 26, of Fairmont, West Virginia, were named in a two-count Indictment. Count One charges HEWEY attempting to possess with intent to distribute marijuana on September 11, 2009, in Fairmont. Count Two charges BURGHARDT with making a false statement to a federal agent on September 14, 2009. If convicted, HEWEY and BURGHARDT face a maximum penalty of 5 years imprisonment and a fine of $250,000.

This case will be prosecuted by Assistant United States Attorney Andrew R. Cogar and was investigated by the United States Postal Inspection Service.

JORDAN LAUDERMILT, age 28, of Wheeling, West Virginia, was named in a one-count Indictment charging him with one count of possession of a firearm on February 27, 2011, in Wheeling, after having previously been convicted of a crime punishable by imprisonment for a term exceeding one year. The Indictment also contains a Forfeiture Allegation wherein the United States seeks to forfeit the firearm. If convicted, LAUDERMILT faces a maximum exposure of 10 years imprisonment and a fine of $250,000 on each count. This case will be prosecuted by Assistant United States Attorney Randolph J. Bernard and was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives.

It should be noted that the charges contained in the Indictment are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
