Rivesville Resident Arrested for Distributing
Heroin and Oxycodone Within 1,000 Feet of a School

CLARKSBURG, WEST VIRGINIA — A 26 year old Rivesville, West Virginia, resident was arrested last week on charges contained in an Indictment returned by a Federal Grand Jury sitting in Clarksburg, West Virginia.

United States Attorney William J. Ihlenfeld, II, announced that MATTHEW W. HAYES was named in a four-count Indictment. Counts One, Three, and Four of the Indictment allege that HAYES distributed heroin within 1,000 feet of Pleasant Valley Elementary School on April 6, 2010; on April 12, 2010; and on April 19, 2010, in Millersville, Marion County, West Virginia. Count Two of the Indictment alleges that HAYES distributed oxycodone within 1,000 feet of Pleasant Valley Elementary School on April 7, 2010, in Millersville.

If convicted, HAYES faces a maximum penalty of 40 years imprisonment and a fine of $2,000,000 on each count of the Indictment.

The arraignment has been scheduled for September 23, 2010, at 10:30 a.m. in Clarksburg.

The case will be prosecuted by Assistant United States Attorney John C. Parr. The case was investigated by the Three Rivers Drug Task Force, consisting of officers from the Fairmont Police Department and the Marion County Sheriff’s Department.

It should be noted that the charges contained in the Indictment are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
