Grand Jury Indicts Five Individuals

MARTINSBURG, WEST VIRGINIA - Five individuals were named in five Indictments returned on November 16, 2010, by a Federal Grand Jury sitting in Martinsburg, West Virginia.

United States Attorney William J. Ihlenfeld, II, announced that:

❶GUY GORDON MARSH, age 65, was named in a one-count Indictment. MARSH is charged with failure to register as a sex offender between August 17, 2010, and October 21, 2010, in the Northern District of West Virginia. If convicted, MARSH faces a maximum penalty of 10 years imprisonment and a fine of $250,000. The case will be prosecuted by Assistant United States Attorney Erin K. Reisenweber and was investigated by the United States Marshals Service.

❷CHARLES DERRICK WATKINS, age 23, of Martinsburg, was named in a two-count Indictment. Count One charges WATKINS with possession of a firearm from August 24, 2010, to August 25, 2010, in Jefferson County, after having previously been convicted of a crime punishable by imprisonment for a term exceeding one year. Count Two charges WATKINS with stealing a firearm on August 24, 2010, in Jefferson County. If convicted, WATKINS faces a maximum exposure of 10 years imprisonment and a fine of $250,000 on each count. This case will be prosecuted by Assistant United States Attorney Erin K. Reisenweber and was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives.

❸VICTOR SOTO ESTRADA a/k/a ANTONIO ESTRADA, age 22, was named in a one-count Indictment. ESTRADA is charged with the reentry into the United States on August 30, 2010, without the consent of the Secretary of Homeland Security nor the Attorney General of the United States to reapply for admission to the United States, after having been deported on June 22, 2010. If convicted, ESTRADA faces a maximum penalty of 2 years imprisonment and a fine of $250,000.

❹ISIDRO CANO ARREGUIN a/k/a JACINTH MARTINEZ-ROJAS, age 39, was named in a one-count Indictment. ARREGUIN is charged with the reentry into the United States on September 20, 2010, without the consent of the Secretary of Homeland Security nor the Attorney General of the United States to reapply for admission to the United States, after having been deported on July 2, 2003, and September 15, 2004. If convicted, ARREGUIN faces a maximum penalty of 2 years imprisonment and a fine of $250,000.

❺ISIDRO FLORES CASTILLO a/k/a JOSE HERNANDEZ-MORENO, age 45, was named in a one-count Indictment. CASTILLO is charged with the reentry into the United States by Removed Alien on March 13, 2010, after having been previously convicted of two felony offenses, without the consent of the Secretary of Homeland Security nor the Attorney General of the United States to reapply for admission to the United States. CASTILLO had been deported on January 12, 1999; June 21, 2001, and January 7, 2002. If convicted, CASTILLO faces a maximum penalty of 10 years imprisonment and a fine of $250,000.

These three cases will be prosecuted by Assistant United States Attorney Erin K. Reisenweber and were investigated by Immigration and Customs Enforcement.

It should be noted that the charges contained in the Indictment are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
