Four Individuals Sentenced in Federal Court

CLARKSBURG, WEST VIRGINIA - Four individuals were sentenced last week in United States District Court in Clarksburg by Judge Irene M. Keeley.

United States Attorney William J. Ihlenfeld, II announced that:

HENRY BREAKEY, age 43, of Lillington, North Carolina (formerly of Marion County, West Virginia), was sentenced on November 23, 2010, to 180 months imprisonment to be followed by three years of supervised release. BREAKEY entered a plea of guilty on January 27, 2010, to being a convicted felon in possession of a stolen Charter Arms .38 caliber revolver on August 25, 2008, in Marion County. BREAKEY was sentenced as an Armed Career Criminal due to prior convictions for the violent felonies of burglary, 2nd degree burglary and 3rd offense of domestic battery. BREAKEY, who is free on bond, will self-report to the designated Federal institution. This case was prosecuted by Assistant United States Attorney Shawn A. Morgan and was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Marion County Sheriff’s Dept.

ANDRE WHITE, age 28, of Clarksburg, West Virginia, was sentenced on November 22, 2010, to 97 months imprisonment to be followed by four years of supervised release. WHITE entered a plea of guilty on June 15, 2010, to one count of aiding and abetting the possession with intent to distribute 24.7 grams of crack cocaine and 50 heroin stamps on January 4, 2009, in Harrison and Doddridge Counties. WHITE was remanded to the custody of the United States Marshal. This case was prosecuted by Assistant United States Attorney Shawn A. Morgan and was investigated by the Harrison/Lewis County Drug & Violent Crime Task Force. The Task Force consists of officers from the Clarksburg Police Department, the Harrison County Sheriff’s Department, the Bridgeport Police Department, the Lewis County Sheriff’s Department, and the Drug Enforcement Administration.

ROBERT ABRAM, age 33, of Pittsburgh, Pennsylvania, was sentenced on November 22, 2010, to 36 months imprisonment to be followed by three years of supervised release. ABRAM entered a plea of guilty on May 18, 2010, to one count of aiding and abetting the distribution of heroin on September 3, 2009, in Monongalia County, West Virginia. ABRAM, who is free on bond, will self-report to the designated Federal institution. This case was prosecuted by Assistant United States Attorney Zelda E. Wesley and was investigated by the Mon Valley Drug & Violent Crime Task Force, consisting of officers from the Morgantown Police Department and the Monongalia County Sheriff’s Department.

JOEL LEVINE, age 44, of Fairmont, West Virginia, was sentenced on November 22, 2010, to 5 years probation, with the first six months being served on home detention with electronic monitoring. LEVINE entered a plea of guilty on July 21, 2010, to one count of being a convicted felon in possession of ammunition on March 7, 2009, in Harrison County. This case was prosecuted by Assistant United States Attorney Zelda E. Wesley and was investigated by the Bureau of Alcohol, Tobacco, Firearms & Explosives.
