One Individual Enters Plea of Guilty
and Three Individuals Sentenced
on Illegal Re-Entry into the United States Charges

MARTINSBURG, WEST VIRGINIA - One individual entered a plea of guilty on April 29, 2010, and three individuals were sentenced on May 12, 2010, in Martinsburg by Chief Judge John Preston Bailey.

United States Attorney Betsy C. Jividen announced that:

❶JORGE PATRICIO-PATRICIO, age 28, entered a plea of guilty to one count of illegal reentry into the United States in January of 2010, without the consent of the Secretary of Homeland Security nor the Attorney General of the United States to reapply for admission to the United States, after having been deported on July 30, 2007. PATRICIO-PATRICIO, who is in custody pending sentencing, faces a maximum penalty of 2 years imprisonment and a fine of $250,000.

➋PEDRO HERNANDEZ, age 33, was sentenced to time served since November 17, 2009, to be followed by one year of supervised release. HERNANDEZ entered a plea of guilty on February 23, 2010, to one count of illegal reentry into the United States on November 17, 2009, without the consent of the Secretary of Homeland Security nor the Attorney General of the United States to reapply for admission to the United States, after having been deported on April 1, 2009. HERNANDEZ, was remanded to the custody of the United States Marshal, awaiting his deportation from the United States.

➌DELFINO ZUNIGA-ORTIZ, age 25, was sentenced to time served since January 25, 2010, to be followed by one year of supervised release. ZUNIGA-ORTIZ entered a plea of guilty on April 29, 2010, to one count of illegal reentry into the United States on January 25, 2010, without the consent of the Secretary of Homeland Security nor the Attorney General of the United States to reapply for admission to the United States, after having been deported on October 23, 2008. ZUNIGA-ORTIZ, was remanded to the custody of the United States Marshal, awaiting his deportation from the United States.

❹ALBERTO LEON-MENDEZ, age 32, was sentenced to time served since January 26, 2010, to be followed by one year of supervised release. LEON-MENDEZ entered a plea of guilty on February 23, 2010, to one count of illegal reentry into the United States on December 28, 2009, without the consent of the Secretary of Homeland Security nor the Attorney General of the United States to reapply for admission to the United States, after having been deported on January 8, 2009, and February 10, 2009. HERNANDEZ, was remanded to the custody of the United States Marshal, awaiting his deportation from the United States.

The cases were prosecuted by Assistant United States Attorney Erin K. Reisenweber and were investigated by Immigration and Customs Enforcement.
