Defendant Entered Guilty Plea to
Illegally Reentering the United States

MARTINSBURG, WEST VIRGINIA — A 21 year old defendant entered a plea of guilty on January 26, 2010, in United States District Court in Martinsburg before Magistrate Judge David J. Joel.

Acting United States Attorney Betsy C. Jividen announced that OMAR ESQUIVEL GARCIA, a citizen of Mexico, entered a plea of guilty to one count of an Indictment charging him with reentering the United States after having been previously removed from the country in January 2009 and without having first obtained permission to reenter as required by law.

GARCIA, who is currently in custody, faces a maximum penalty of two years imprisonment and a fine of $250,000.

The case was prosecuted by Assistant United States Attorney Erin K. Reisenweber. The case was investigated by the Department of Homeland Security - Immigration and Customs Enforcement and the West Virginia State Police.
