Three Individuals Entered Guilty Pleas
to Drug and Firearms Violations

ELKINS, WEST VIRGINIA — Three individuals entered guilty pleas on January 25, 2010, in United States District Court in Elkins before Magistrate Judge John S. Kaull.

Acting United States Attorney Betsy C. Jividen announced that:

JOSHUA RYAN MCGUIRE, age 22, of Weston, West Virginia, entered a plea of guilty to one count of an Indictment charging him with stealing a firearm from a federally licensed firearms dealer on September 18, 2008, in Weston. MCGUIRE faces a maximum penalty of 10 years imprisonment and a fine of $250,000. The case was prosecuted by Assistant United States Attorney Stephen D. Warner. The case was investigated by the Bureau of Alcohol, Tobacco, Firearms & Explosives; the Harrison/Lewis County Drug & Violent Crimes Task Force; and the Weston Police Department. The Task Force consists of officers from the Clarksburg Police Department, the Harrison County Sheriff’s Department, the Bridgeport Police Department, the Lewis County Sheriff’s Department, and the Drug Enforcement Administration.

FLOYD EDWARD ROBY, age 32, of Buckhannon, West Virginia, entered a plea of guilty to one count of an Indictment charging him with possessing materials to be used in the manufacture of methamphetamine on March 26, 2009, in Upshur County. ROBY faces a maximum penalty of 10 years imprisonment and a fine of $250,000. The case was prosecuted by Assistant United States Attorney Stephen D. Warner. The case was investigated by the Upshur County Sheriff’s Department, the West Virginia State Police - Bureau of Criminal Investigation, and the Drug Enforcement Administration.

TIMOTHY ALLEN WHITACRE, age 48, of Gormania, West Virginia, entered a plea of guilty to one count of an Indictment charging him with the distribution of cocaine hydrochloride, also known as “coke,” on March 4, 2009, in Grant County. WHITACRE faces a maximum penalty of 20 years imprisonment and a fine of $250,000. The case was prosecuted by Assistant United States Attorney Paul T. Camilletti. The case was investigated by the Drug Enforcement Administration.
