Two Named in Federal Drug Indictments

ELKINS, WEST VIRGINIA — A Federal Grand Jury sitting in Elkins, West Virginia, returned two federal drug Indictments on October 20, 2009.

Acting United States Attorney Betsy C. Jividen announced that:

BRENDA SUE WHITE, age 51, was named in a four-count Indictment. Count One of the Indictment alleges that WHITE conspired to distribute cocaine, also known as “coke,” from the Summer of 2008 to the Spring of 2009 in Randolph County, West Virginia, and elsewhere. Counts Two and Three allege that WHITE distributed cocaine on July 25 and 30, 2008, in Randolph County. Count Four of the Indictment alleges that WHITE possessed cocaine with the intent to distribute on April 17, 2009, in Randolph County. The Indictment also includes a forfeiture wherein the United States seeks to forfeit from WHITE the following items: United States currency, a safe, a scanner, a digital camera, two cell phones, a walkie talkie, a surveillance system, and a laptop with carrying case.

If convicted, WHITE faces a maximum penalty of 20 years imprisonment and a fine of $1,000,000 on each count of the Indictment.

The case will be prosecuted by Assistant United States Attorney Stephen D. Warner. The case was investigated by the Randolph County Sheriff’s Department.

FLOYD EDWARD ROBY, age 31, of Buckhannon, West Virginia, was named in a three-count Indictment. Count One of the Indictment alleges that ROBY manufactured methamphetamine on March 26, 2009, in Upshur County. Count Two of the Indictment alleges that ROBY possessed material used in the manufacture of methamphetamine on March 26, 2009, in Upshur County. Count Three of the Indictment alleges that ROBY possessed pseudoephedrine to be used in the manufacture of methamphetamine on March 26, 2009, in Upshur County.

If convicted, ROBY faces a maximum penalty of 20 years imprisonment and a fine of $1,000,000 on Count One of the Indictment; a maximum penalty of 10 years imprisonment and a fine of $250,000 on Count Two of the Indictment; and a maximum penalty of 20 years imprisonment and a fine of $250,000 on Count Three of the Indictment.

The case will be prosecuted by Assistant United States Attorney Stephen D. Warner. The case was investigated by the Upshur County Sheriff’s Department.

It should be noted that the charges contained in the Indictments are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
