Rosedale Residents Convicted on Marijuana Charges

CLARKSBURG, WEST VIRGINIA — On October 2, 2009, two Rosedale, West Virginia, residents were convicted on two counts after a three-day trial by a Federal trial jury in United States District Court in Clarksburg before Judge Irene M. Keeley.

Acting United States Attorney Betsy C. Jividen announced that: EDGAR HENRY and KIMBERLEY HENRY were found guilty on one count of conspiracy to manufacture, distribute, and possess with intent to distribute more than 100 marijuana plants between July 16, 2000, and July 21, 2004, in Rosedale and on count of aiding and abetting each other in manufacturing more than 100 marijuana plants between July 16, 2000, and July 21, 2004, in Rosedale. They were acquitted on one count of aiding and abetting the possession with intent to distribute less than 50 kilograms of marijuana on July 21, 2004, in Rosedale. The jury also found in favor of the government’s favor as to forfeiture of the defendants’ 77-acre farm being situate in the head of Anthony Fork of Mill Fork of Steer Creek, in Center District, Gilmer County, West Virginia. The defendants also administratively forfeited $1,800 to the DEA.

The defendants each face a maximum exposure of five to 40 years imprisonment and a fine of $2,000,000 each on count.

The case was prosecuted by Assistant United States Attorneys Shawn Angus Morgan and Erin K. Reisenweber. The case was investigated by the West Virginia State Police - Bureau of Criminal Investigations and the Drug Enforcement Administration.
