Defendant Entered Guilty Plea to Firearms Violation

ELKINS, WEST VIRGINIA — A 39 year old defendant entered a plea of guilty on October 27, 2009, in United States District Court in Elkins before Judge Robert E. Maxwell.

Acting United States Attorney Betsy C. Jividen announced that KIRK C. GUTH entered a plea of guilty to one count of an Indictment charging him with unlawfully possessing a firearm on December 8, 2006, in Upshur County, after having been previously convicted of a crime punishable by imprisonment for a term exceeding one year.

GUTH, who is currently in custody, faces a maximum penalty of 10 years imprisonment and a fine of $250,000.

The case was prosecuted by Assistant United States Attorney Stephen D. Warner. The case was investigated by the Upshur County Sheriff’s Department and the Bureau of Alcohol, Tobacco, Firearms & Explosives.
