Two Indicted on “Crack” Cocaine Charges

ELKINS, WEST VIRGINIA — Two individuals were named in an Indictment returned on February 18, 2009, by a Federal Grand Jury sitting in Elkins, West Virginia.

United States Attorney Sharon L. Potter announced that STEVEN GREEN, age 38, and CHERYL GOFF, age 44, of Fairmont, were named in a three-count Indictment. Count One of the Indictment alleges that GREEN and GOFF conspired to possess with intent to distribute more than five grams of cocaine base from September 2008, to October 9, 2008, in Fairmont, West Virginia, and elsewhere.

GREEN was named in Count Two of the Indictment alleging that he possessed with intent to distribute more than five grams of cocaine base on October 9, 2008, in Fairmont.

GOFF was named in Count Three of the Indictment alleging that she maintained a residence in Fairmont for the purpose of manufacturing, distributing, and using cocaine base from September 2008 to October 2008 in Fairmont.

The Indictment also carries a forfeiture allegation wherein the United States seeks to forfeit any property constituting or derived from proceeds obtained directly or indirectly from the violations alleged in the Indictment. This includes, but is not limited to, $1,192.00 in United States currency seized during the execution of a search warrant at a residence in Fairmont on October 9, 2008.

If convicted, the defendants face a maximum penalty of five to 40 years imprisonment and a fine of $2,000,000 each on Counts One and Two of the Indictment; and a maximum penalty of 20 years imprisonment and a fine of $500,000 on Count Three of the Indictment.

The case will be prosecuted by Assistant United States Attorney Andrew R. Cogar. The case was investigated by the Three Rivers Drug Task Force, consisting of officers from the Fairmont Police Department and the Marion County Sheriff’s Department.

It should be noted that the charges contained in the Indictment are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.
