Powhatan Man Charged with Production and Distribution of Child Pornography

(Richmond, Va.) – James Edward May, II, 41, of Powhatan County, Virginia, was indicted by a federal grand jury in Richmond on three counts of producing and two counts of distributing child pornography.  Neil H. MacBride, United States Attorney for the Eastern District of Virginia, made the announcement following the indictment.  Production of child pornography carries a 15-year mandatory minimum sentence, and distribution of child pornography carries a 5-year mandatory minimum sentence.

            Court documents allege that May used a cellular telephone to produce child pornographic images of a four year-old and a seven year-old child in 2011.  It is also alleged that May distributed child pornography images using a cellular telephone in November, 2011 and December, 2011. 

This case is being investigated by agents of the U.S. Department of Homeland Security and Powhatan County Sheriff's Office.  Special Assistant United States Attorney Gene Fishel of the Virginia Attorney General’s Office is prosecuting the case on behalf of the United States.

            Criminal indictments are only charges and not evidence of guilt. A defendant is presumed to be innocent until and unless proven guilty.
