NORFOLK, Va. - Brian Gay, 52, of Virginia Beach, Va., was sentenced today to 60 months in prison and ordered to pay $398,953.00 in restitution for his convictions on mail and wire fraud, false statements, and unlawful monetary transactions.

            Neil H. MacBride, United States Attorney for the Eastern District of Virginia, made the announcement after Gay was sentenced by United States District Judge Raymond A. Jackson.  

            According to court records and evidence at trial, Gay was an attorney licensed to practice law in Virginia and maintained a law practice in Virginia Beach.  In 2006, he qualified as the executor of the estate and trustee for the trust of a Virginia Beach resident who died in 2006.  The trust was to be funded by $520,000 in life insurance proceeds for the benefit of the decedent’s minor children.  Gay devised a scheme to defraud and converted and misapplied the proceeds of the life insurance policies primarily for his own benefit and not the minor children.  From the period of July 2006 continuing until later 2010, Gay embezzled over $390,000 from the Estate of Daniel M. Woodside.

            This case was investigated by the United States Postal Inspection Service and the    United States Secret Service.  Supervisory Assistant United States Attorney Robert J. Seidel, Jr. and Assistant United States Attorney V. Kathleen Dougherty are prosecuting the case on behalf of the United States.
