South Shore Man Sentenced for Failure to Pay Legal Child Support

US Attorney Brendan V. Johnson announced that a South Shore, South Dakota, man charged with Failure to Pay Legal Child Support was sentenced on May 11, 2012, by Chief US District Judge Karen E. Schreier. Benjamin J. Boyle, age 36, was sentenced to 6 months of home detention, 5 years of probation, a $100 special assessment to the Victim Assistance Fund, and child support restitution in the amount of $34,990.66.

Boyle was indicted for failing to pay over $35,000 in past due child support to two separate custodial parents of his minor children by a federal grand jury on November 1, 2011. He was ordered by the Third Judicial Circuit Court, Codington County, South Dakota, to pay one of the custodial parents $571 per month for his minor children, commencing July 1, 2007, and it was amended twice. At the time of indictment, he had not made a child support payment since November of 2010, and the total arrearage amount owed was $30,441.58.

In addition, Boyle was ordered by the Third Judicial Circuit Court, Codington County, to pay a second custodial parent $389 per month for his minor child, commencing July 31, 2008. At the time of indictment, the total arrearage amount owed to the second custodial parent was $5,620.88. He pleaded guilty to the charges on February 22, 2012.

This case was investigated the Department of Health and Human Services, Office of Inspector General. Assistant US Attorney Thomas J. Wright prosecuted the case.
