Kyle Man Pleads Guilty to Selling Property Owned by Oglala Lakota College

United States Attorney Brendan V. Johnson announced that Brandon Ferguson, age 29, of Kyle, South Dakota, appeared before United States District Judge Jeffrey L. Viken on November 28, 2012, and pled guilty to an indictment that charged him with Embezzlement and Theft from an Indian Tribal Organization. The maximum penalty upon conviction is 5 years of imprisonment and a $250,000 fine.

Ferguson was indicted for taking and selling property owned by the Oglala Lakota College between February and June, 2012. The investigation was conducted by the Bureau of Indian Affairs, Office of Justice Services, and the Oglala Sioux Tribe Department of Public Safety.

A presentence investigation was ordered, and a sentencing date was set for April 1, 2013. The defendant was remanded to the custody of the United States Marshal pending sentencing.
