Martin Man Indicted for Assault Resulting in Serious Bodily Injury

United States Attorney Brendan V. Johnson announced that a Martin, South Dakota, man has been indicted by a federal grand jury for Assault Resulting in Serious Bodily Injury. The indictment alleges that Everett Libby, age 26, assaulted another male individual at Sunrise Housing in Martin on November 21, 2011. Said assault resulted in the victim receiving serious bodily injury.

Libby appeared before United States Magistrate Judge Veronica L. Duffy on January 3, 2012, and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years' imprisonment and/or a $250,000 fine. The charge is merely an accusation, and Libby is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Bureau of Indian Affairs and the Oglala Sioux Tribe Department of Public Safety. Libby was remanded to the custody of the United States Marshal. A trial date has not yet been set.
