Ohio Man Pleads Guilty In Crack Cocaine Distribution Scheme
PITTSBURGH, Pa. ‑ A resident of Cleveland, Ohio, pleaded guilty in federal court, to a charge of violating federal narcotics laws, United States Attorney David J. Hickton announced today.
James Henry, a/k/a Herk, 28, of Cleveland, Ohio pleaded guilty to one count before Senior United States District Judge Alan N. Bloch.
In connection with the guilty plea, the court was advised that from on or about May 7, 2008, to on or about Oct. 9, 2008, in the Western District of Pennsylvania and elsewhere, Henry knowingly, intentionally, and unlawfully conspired with persons known and unknown to distribute and possess with intent to distribute 50 grams or more of a mixture and substance containing a detectable amount of cocaine base, in a form commonly known as crack, a Schedule II controlled substance.
Judge Bloch scheduled sentencing for Jan. 20, 2011, at 11:30 a.m. The law provides for a total sentence of not less than ten years to a maximum of life in prison, a fine of $4,000,000, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed is based upon the seriousness of the offense and the criminal history, if any, of the defendant.
Pending sentencing, the court revoked Henry's bond and had him placed into custody.
Assistant United States Attorney Amy L. Johnston is prosecuting this case on behalf of the government.
The Drug Enforcement Administration (DEA) conducted the investigation that led to the prosecution of James Henry.
