Pain Management Doctor Agrees to Pay U.s. Department of Justice over $1 Million to Resolve Medicare Fraud Allegations
Las Vegas, Nev. – A Las Vegas pain management doctor has entered into a settlement agreement with the U.S. Department of Justice to resolve civil allegations of health care fraud to Medicare and other federal health care programs, announced Daniel G. Bogden, United States Attorney for the District of Nevada.
The settlement agreement, effective December 13, 2011, states that Steven Kozmary, M.D., who owns and operates the Kozmary Center for Pain Management in Las Vegas, agreed to pay $1,062,072 to the United States to resolve allegations that between July 1, 2007, and December 31, 2010, he improperly billed Medicare, TRICARE, and the Federal Employee Health Benefits Program for services. The agreement states that the agencies reserve the right to seek to exclude and debar Dr. Kozmary from all federal health care programs.
The settlement agreement states that it is neither an admission of liability by the health care providers nor a concession by the United States that its claims are not well founded.
Assistant United States Attorney Roger Wenthe handled the case on behalf of the U.S. Attorney's Office. The case was investigated by the Office of the Inspector General for the U.S. Department of Health and Human Services.
