Former Teamster Union Officer Sentenced to Two Years in Prison for Embezzlement
Reno, Nev. – A former secretary and treasurer of the Teamsters Union, Local 533, was sentenced today to two years in prison for embezzling about $125,000 from the union during 2006 to 2009, announced Daniel G. Bogden, United States Attorney for the District of Nevada.
Mark Winfield Tracy, 65, formerly of Reno, and currently of Ocala, Florida, was sentenced by U.S. District Judge Robert C. Jones to two years in prison, three years of supervised release, a $10,000 fine, and ordered to pay $87,119 to the union. Judge Jones sentenced Tracy at the maximum end of the federal sentencing guidelines range, finding that he had abused a position of trust. Tracy pleaded guilty on December 6, 2010, to embezzlement of labor union assets,
During 2006 to 2009, Tracy was employed as the Secretary/Treasurer by Teamsters Local 533 in Reno and was subject to the federal Labor-Management Reporting and Disclosure Act of 1959. During that period, Tracy knowingly and fraudulently used union funds to pay for unauthorized personal expenses, which he charged on two union credit cards. Tracy also caused false reports to be filed about the unauthorized disbursements, and fabricated union credit card account statements and receipts to falsify supporting documentation for his unauthorized credit card use.
Tracy was permitted to self-report to federal prison by September 30, 2011.
The investigation was conducted by the U.S. Department of Labor Office of Labor- Management Standards and the case was prosecuted by Assistant U.S. Attorney Ronald C. Rachow.
