Greensboro, N.C. – United States Attorney for the Middle District of North Carolina, Anna Mills Wagoner, announced that David TSUI, 37, a podiatrist and president of Dr. 2 Shoes, Inc. (“DR. 2 SHOES”) of Chapel Hill, North Carolina, was indicted this week by a federal grand jury on charges that he allegedly submitted false claims for diabetic shoes provided to Medicare beneficiaries in excess of $500,000.00.

A forty-three (43) count indictment was returned against TSUI and DR. 2 SHOES, INC., on December 17, 2007. The indictment charges TSUI and the corporation with five counts of false claims under Title 18, United States Code, Section 287; three counts of false entries relating to health care matters under Title 18, United States Code, Section 1035; twenty-one counts of wire fraud under Title 18, United States Code, Section 1343; four counts of health care fraud under Title 18, United States Code, Section 1347; and ten counts of aggravated identity theft under Title 18, United States Code, Section 1028A; related to his unauthorized use of physician Medicare provider numbers.

If convicted, TSUI faces maximum penalties of not more than twenty (20) years imprisonment for the wire fraud charges and an additional two (2) years sentence for each aggravated identity theft count.

This investigation was conducted by the U.S. Department of Health and Human Services, Office of Inspector General in Greensboro, North Carolina.

The public is cautioned that an indictment is a formal method of issuing charges. It does not, in and of itself, create an inference of guilt. An individual is presumed innocent until such time, if ever, as the government establishes his or her guilt by competent evidence beyond a reasonable doubt.
