New Bern, North Carolina - United States Attorney Thomas G. Walker announced that in federal court today before Chief United States District Judge Louise W. Flanagan, MICHAEL GENE CHERRY, of Rocky Mount, NC, was sentenced to a 63 month term of imprisonment, followed by 3 years of supervised release, on the charge of being a Felon in Possession of a Firearm, in violation of Title 18, United States Code, Section 922(g) and 924.

The investigation of this case revealed that on September 10, 2010 officers with the Rocky Mount Police Department responded to a reported break-in on Reedy Branch Road in Rocky Mount.  A resident reported that a loaded .22 caliber handgun had been stolen.  Officers had recently dropped off CHERRY near the location of the break-in earlier in the evening as a courtesy.  CHERRY’S probation officer and the Nash County Sheriff’s Office went to CHERRY’S residence where they found him sitting on the stolen handgun.  CHERRY admitted to his girlfriend that he had committed the break-in and theft of the firearm.

Investigation of this case was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Rocky Mount Police Department, with the assistance of the Nash County Sheriff’s Office.  Assistant United States Attorney William M. Gilmore represented the United States.
