RALEIGH - United States Attorney Thomas G. Walker announced that in federal court yesterday Senior United States District Judge Malcolm J. Howard sentenced JASON BROCK SPENCER, 31, to 216 months imprisonment followed by five years supervised release. 

     A Federal Grand Jury returned an Indictment on September 16, 2011, charging unlawful possession of a firearm by a convicted felon, in violation of Title 18, United States Code, Sections 922(g)(1) and 924.  At his arraignment on January 4, 2012, he pled guilty to the charge. 

According to the investigation, on December 29, 2010, Pitt County deputies were looking into a break-in in Grimesland, North Carolina.  Upon reviewing a security video, one of the burglars, SPENCER, was recognized. Later that day, when investigators approached SPENCER’s residence, one of the investigators observed SPENCER and another individual moving items into a van.

While speaking with SPENCER, one of the investigators  observed a firearm in plain view in the van. After permission was granted to search the van, five firearms were recovered.  The defendant admitted that he and the other person had stolen the firearms from a neighboring residence.  Tracks could be seen coming to and from an adjacent residence.  The owner of the residence was contacted and was able to identify the weapons as his property. The firearms included a Mossberg 100, ATR bolt action .270 caliber rifle; a Remington model 788 bolt action .308 caliber rifle; a Remington 100 12-gauge shotgun; a Stevens model 94 410-gauge shotgun; and a Kmart model 151 20-gauge shotgun.

This case was part of the Project Safe Neighborhoods (PSN) initiative which encourages federal, state, and local agencies to cooperate in a unified “team effort” against gun crime, targeting repeat offenders who continually plague their communities.

Investigation of this case was conducted by the Pitt County Sheriff’s Deputies and the Bureau of Alcohol, Tobacco, Firearms and Explosives.  Assistant United States Attorney John Bennett prosecuted the case.
