Stanley Robert Smith Sentenced in U.S. District Court

The United States Attorney's Office announced that during a federal court session in Missoula, on July 7, 2011, before U.S. District Judge Donald W. Molloy, STANLEY ROBERT SMITH, a 53-year-old resident of Butte, appeared for sentencing. SMITH was sentenced to a term of:

Prison: 12 months and 1 day

Special Assessment: $100

Supervised Release: 4 years

SMITH was sentenced in connection with his guilty plea to possession with the intent to distribute marijuana.

In an Offer of Proof filed by Assistant U.S. Attorney Timothy J. Racicot, the government stated it would have proved at trial the following:

On November 10, 2010, SMITH was arrested by law enforcement officers in Butte. After he was arrested, the officers applied for and received search warrants for his car, his residence, a camp trailer, and one of his three storage units.

During the search of the car, officers seized a baggy of marijuana from the driver's side floorboard and a Taurus .357 Magnum handgun from underneath the armrest between the driver and passenger seats.

A search of the camp trailer led to the seizure of a black bag that contained six separately packaged bags of marijuana. The trailer also contained a digital scale and baggies consistently used by drug dealers to package controlled substances for distribution.

From the storage unit officers seized a black tote bag that contained plastic baggies of marijuana and another digital scale.

The total weight of the marijuana seized from the car, the camp trailer, and the storage unit was just over one kilogram.

Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that SMITH will likely serve all of the time imposed by the court. In the federal system, SMITH does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.

The investigation was a cooperative effort between the U.S. Homeland Security Investigations and the Butte-Silver Bow Law Enforcement Agency.
