Ryan Edward Mccreary Sentenced in U.S. District Court
The United States Attorney's Office announced that during a federal court session in Helena, on March 11, 2010, before Senior U.S. District Judge Charles C. Lovell, RYAN EDWARD McCREARY, a 29-year-old resident of Tacoma, Washington, appeared for sentencing. McCREARY was sentenced to a term of:
- Prison: 120 months
- Special Assessment: $100
- Supervised Release: 8 years
McCREARY was sentenced in connection with his guilty plea to possession with the intent to distribute methamphetamine.
In an Offer of Proof filed by Assistant U.S. Attorney Paulette L. Stewart, the government stated it would have proved at trial the following:
On March 27, 2009, Helena area law enforcement stopped and arrested McCREARY on a warrant for Washington State Probation (WSP). WSP also asked Helena area law enforcement to search McCREARY and his vehicle for them. Officers located 64 grams of a mixture containing methamphetamine in McCREARY'S backpack.
When interviewed on March 30, 2009, McCREARY admitted bringing over 72 grams of a mixture containing methamphetamine from Washington to Helena to sell.
Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that McCREARY will likely serve all of the time imposed by the court. In the federal system, McCREARY does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.
The investigation was conducted by a cooperative effort between the Missouri River Drug Task Force and the Bureau of Immigration and Customs Enforcement.
