Informational: Federal Court Arraignments

Bill Mercer, United States Attorney for the District of Montana, announced today that during a federal court session in Great Falls, on February 26, 2009, before U.S. Magistrate Judge Keith Strong, the following individuals were arraigned:

CURTIS DUSTIN OLD CHIEF, a 22-year-old resident of Browning, appeared on a charge of involuntary manslaughter. He is currently detained. If convicted of this charge, OLD CHIEF faces possible penalties of 8 years in prison, a $250,000 fine and 3 years supervised release. Assistant U.S. Attorney Vince Carroll is the prosecutor for the United States. The investigation was conducted by the Federal Bureau of Investigation in Browning.

CHRISTOPHER DEAN BOY, a 38-year-old resident of Browning, appeared on a charge of distribution of methamphetamine in a school zone. He is currently detained. If convicted of this charge, BOY faces possible penalties of a mandatory minimum of 1 year in prison and could be sentenced to 40 years, a $1,000,000 fine and a minimum of 6 months supervised release. Assistant U.S. Attorney Vince Carroll is the prosecutor for the United States. The investigation was conducted by the Blackfeet Safe Trails Task Force.

ANNA REA YELLOW OWL, a 40-year-old resident of Browning, appeared on a charge of distribution of cocaine in a public housing facility. She is currently detained. If convicted of this charge, YELLOW OWL faces possible penalties of a mandatory minimum of 1 year in prison and could be sentenced to 40 years, a $1,000,000 fine and a minimum of 6 months supervised release. Assistant U.S. Attorney Vince Carroll is the prosecutor for the United States. The investigation was conducted by the Blackfeet Safe Trails Task Force.

DAVID YAZZIE, a 44-year-old resident of Chinly, Arizona, appeared on a charge of possession with the intent to distribute methamphetamine. He is currently detained. If convicted of this charge, YAZZIE faces possible penalties of a mandatory minimum of 5 years in prison and could be sentenced to life, a $2,000,000 fine and 4 years supervised release. Assistant U.S. Attorney Vince Carroll is the prosecutor for the United States. The investigation was conducted by the Blackfeet Safe Trails Task Force.

ALVALINE DEROCHE, a 33-year-old resident of Browning, appeared on a charge of distribution of cocaine. He is currently detained. If convicted of this charge, DEROCHE faces possible penalties of a 20 years in prison, a $1,000,000 fine and 2 years supervised release. Assistant U.S. Attorney Vince Carroll is the prosecutor for the United States. The investigation was conducted by the Blackfeet Safe Trails Task Force.

EVA MARIE GREEN RED HEAD, a 62-year-old resident of Browning, appeared on a charge of distribution of methadone. She is currently detained. If convicted of this charge, RED HEAD faces possible penalties of a mandatory minimum of 1 year in prison and could be sentenced to 40 years, a $1,000,000 fine and a minimum of 6 months supervised release. Assistant U.S. Attorney Vince Carroll is the prosecutor for the United States. The investigation was conducted by the Blackfeet Safe Trails Task Force.

The defendants pled not guilty to the charges.

The charge, an indictment, information or complaint, is merely an accusation and all persons named as defendants are presumed innocent until proven guilty. A pre-trial conference and a trial date will be set and the United States will be required to prove the allegations set forth in the indictment beyond a reasonable doubt.
