Frederick Man Charged with Federal Gun and Drug Crimes

BALTIMORE, Maryland – United States Attorney Rod J. Rosenstein and Frederick County State’s Attorney Charlie Smith announced today that Gary Holloway, a/k/a “Punchy,” age 32, of Frederick, has been indicted in federal court on multiple counts of drug dealing and illegal possession of a firearm.

“Exemplary coordination by local, state and federal law enforcement agencies is enabling us to make significant progress in fighting violent crime in Frederick County,” said U.S. Attorney Rod J. Rosenstein

“We are going to continue to target the violent criminals and gang members for Exile. We need to stop their spread in our community and continue to send a message to those outside of Frederick County that they cannot bring their violence here,” said State’s Attorney Charlie Smith.

A federal grand jury in Baltimore returned the indictment on September 9, 2009, and the case was assigned to U.S. District Judge Richard D. Bennett. Holloway has not yet appeared in federal court.

Holloway faces maximum sentences of up to life in prison on the gun charge and up to 20 years in prison on the drug charges. In the federal system, there is no probation and no parole.

The indictment alleges that Holloway participated in a conspiracy to distribute crack cocaine, heroin and marijuana. On May 13, 2009, the indictment alleges that Holloway possessed a .45 caliber revolver in furtherance of a drug trafficking crime.

Holloway is the fifth defendant prosecuted under the Frederick County EXILE program, which is a coordinated effort by local, state and federal agencies to fight violent crime.

A person charged by indictment is presumed innocent unless and until proven guilty in court.

Rosenstein and Frederick County State’s Attorney Charlie Smith thanked the Frederick Police Department under Chief Kim Dine, the Frederick County Sheriff’s Office under Sheriff Chuck Jenkins, and the Bureau of Alcohol, Tobacco, Firearms and Explosives for their work in this investigation. Mr. Rosenstein and Mr. Smith commended Assistant U.S. Attorney John Sippel, who is prosecuting the case and Assistant State’s Attorneys Melissa Bender and Jason Shoemaker who assisted in the investigation.
